What is British citizenship by descent?

British citizenship by descent is how British nationality passes from a parent to a child born outside the UK. If one of your parents was a British citizen when you were born, there's a good chance you inherited that citizenship automatically – even if you've never lived in the UK or applied for anything.

That said, it's not quite as simple as it sounds. There are rules around how citizenship can be passed down, and in most cases, it doesn't automatically continue beyond one generation born abroad. Whether you qualify – and what that means for your family – comes down to a few key details about your parents and when and where you were born.

Who qualifies for British citizenship by descent?

British citizenship by descent applies to people born outside the UK to a British parent. Unlike other routes, it is not something you apply for – if you qualify, you are already a British citizen and can apply for a British passport straight away.

To qualify, three conditions must be met:

  • You were born outside the UK
  • At least one parent was a British citizen at the time of your birth
  • That parent held citizenship otherwise than by descent – meaning they became British through birth in the UK, registration, or naturalisation, rather than through their own parent

That third point is the one that catches most people out, and it is worth understanding before assuming you qualify.

Citizenship by descent vs otherwise by descent

A British citizen otherwise than by descent can pass citizenship to a child born abroad. A British citizen by descent generally cannot. This is the mechanism that limits citizenship from travelling indefinitely down a family line born outside the UK.

In practical terms, it means that if your British parent was themselves born abroad and acquired citizenship through their own parent, they may be classed as British by descent – and the chain stops there.

Does your date of birth matter? The 1983 cut-off and what it means

The rules around how citizenship passes changed significantly on 1 January 1983 with the British Nationality Act 1981. For children born before that date, different rules applied – and in many cases, citizenship could only pass through a father, not a mother.

If you were born before 1983 and believe you may have missed out on citizenship because it could not pass through your mother, this is not necessarily the end of the road. Section 4L was introduced specifically to address that historical discrimination and may provide an alternative route.

Who does not qualify

British citizenship by descent does not apply in the following situations:

  • Your British parent was themselves British by descent and was born outside the UK
  • You were adopted – different rules apply and a separate assessment is needed
  • Your parent renounced British citizenship before your birth – different rules apply and a separate assessment is needed 
  • You were born before 1 January 1983, and citizenship could only have passed through your mother under the old rules – though Section 4L may still offer a route
  • Your parent was a British national but not a British citizen – British national status does not automatically confer citizenship by descent

Can you get British citizenship through a grandparent

If your grandparent – rather than your parent – was the British citizen, the position is more complex. As a general rule, citizenship by descent does not pass automatically across two generations born outside the UK.

However, there are circumstances in which a claim through grandparents may still be possible, particularly where the grandparent was born in the UK or where historical discrimination affected the line of descent. This is sometimes referred to as double descent, and it is a specialist area of nationality law.

How to apply for British citizenship by descent?

If you qualify for British citizenship by descent, you don't need to apply to become British – you already are. The process is really just about confirming that status and getting the paperwork in order.

Things can get a little more complex, for example, if there are questions around how your parent became British, or whether older legislation affected your entitlement – it's worth getting a proper assessment before you apply. Getting it wrong can cause unnecessary delays.

British citizenship by descent processing times

For most people, formalising British citizenship by descent means applying for a British passport – and how long that takes depends on where you're applying from.

If you're applying through His Majesty's Passport Office in the UK, standard applications currently take up to 6 - 10 weeks. Applying from outside the UK through a British consulate can take longer, depending on where you are in the world.

Processing times can also shift during busy periods, so if you have travel coming up, it's always worth applying earlier than you think you need to.
