Can you transfer a foreign pension to Australia? Potentially, but the tax treatment depends on the type of pension, when you became an Australian tax resident, when you transfer the funds and how the overseas arrangement is classified under Australian tax law. In some cases, the growth in a foreign pension may be taxable in Australia.

If you have worked overseas and built up a pension in the UK, South Africa, the US or Canada, transferring it to Australia may seem like a straightforward way to bring your retirement savings together.

However, foreign pensions are not all treated the same way under Australian tax law.

How are foreign pensions taxed in Australia?

One important concept is Applicable Fund Earnings (AFE).

Broadly, where Australian tax rules apply to a lump sum from a foreign superannuation fund received more than six months after you become an Australian tax resident, the AFE can represent the growth in your pension interest during the relevant period of Australian tax residency. This amount may be taxable in Australia.

The calculation can be more complicated than simply looking at how much your pension has grown. Your pension's value when you became an Australian resident, the transfer date and your residency history can all matter.

There is also an important six-month rule. In certain circumstances, a lump sum received within six months of becoming an Australian resident may be tax-free.

However, not every overseas pension is treated as a foreign superannuation fund for Australian tax purposes. You therefore cannot assume that the rules applying to one country's pension will apply to another.

Four pensions, four different questions

Imagine you have built up retirement savings overseas and are now moving to Australia. Your next steps could look quite different depending on where those savings are held.

  • UK pension: You have built up a UK personal pension before moving to Australia. Before transferring it, you need to consider how the pension is classified in Australia, the timing of the transfer and whether UK pension rules create additional considerations.
  • South African pension: You are returning to Australia with a South African retirement annuity. Its Australian tax treatment needs to be considered alongside the rules that applied while you were a South African tax resident and the specific terms of your pension arrangement.
  • US pension: You have a 401(k) or another US retirement arrangement. You should not assume it automatically falls under Australia's foreign superannuation rules. The nature of the arrangement needs to be established first.
  • Canadian pension: You have retirement savings in Canada and want to transfer them after becoming an Australian resident. The type of Canadian pension, your residency history and how Australia classifies the arrangement can all affect the tax outcome.

The country where your pension is held matters, but the type of pension and how Australia classifies it matter just as much.

There is no single Australian tax rule that applies to all foreign pensions. The tax treatment depends on the type of overseas pension, how it is classified under Australian tax law, your Australian tax residency and the timing of any transfer.

A pension transfer can also have tax consequences in more than one country. Acting before understanding those consequences could leave you with an unexpected tax bill or limited options later.
