Can New Zealand citizens apply directly for Australian citizenship?

Yes. Since 1 July 2023, New Zealand citizens holding a Special Category visa (subclass 444) can apply for Australian citizenship by conferral without first obtaining a separate permanent visa, provided they meet the citizenship requirements.

This is not automatic citizenship. For citizenship purposes, SCV holders are treated as permanent residents under specific rules, even though the SCV remains a temporary visa for other purposes.

Direct citizenship route

Available to qualifying SCV holders since 1 July 2023.

Separate permanent visa

Not normally required before citizenship via the SCV pathway.

General residence requirement

Four years living lawfully in Australia immediately before applying.

Travel history

Time spent outside Australia can affect your eligibility date.

What are the Australian citizenship requirements for SCV holders?

For most adult applicants using the general residence pathway, you must:

  • Hold an SCV or Australian permanent visa when you apply and when the decision is made.
  • Have lived in Australia lawfully for four years immediately before applying, including the final 12 months with the qualifying SCV or permanent residence status.
  • Have spent no more than 12 months outside Australia in those four years, including no more than 90 days in the final 12 months.
  • Meet the applicable identity, character and citizenship knowledge or test requirements. Most applicants must be in Australia when the decision is made.

Different requirements or exemptions can apply to children, older applicants and people in particular circumstances. Most adults who are approved must also make the pledge of commitment at a citizenship ceremony.

How does time on a Special Category visa count?

For citizenship purposes, if you were granted an SCV before 1 July 2022, you are generally treated as having permanent residence from 1 July 2022. If your first SCV was granted on or after 1 July 2022, the relevant date is generally that first grant date. You must still meet the four-year lawful residence and absence rules.

Your earlier visa history and travel dates matter. The Australian Government’s Residence Calculator can help you estimate when you may be eligible.

What if you have not moved to Australia yet?

New Zealand citizens with a valid New Zealand passport usually do not need to apply for a visa before travelling to Australia. If you meet the entry requirements, you may be granted an SCV on arrival. It generally allows you to live, work and study in Australia without employer sponsorship.

An SCV is temporary and ordinarily ceases when you leave Australia. A new SCV may be granted when you return if you remain eligible. If you have a criminal history or previous visa cancellation, check your entry position before travelling. Simply holding a New Zealand passport does not satisfy the citizenship residence requirement.

Could your family’s visa or citizenship status change your plans?

Your partner’s or child’s position may be different from yours. Before applying for citizenship, consider:

  • New Zealand citizen family members must each qualify for their own SCV.
  • Some non-New Zealand family members may qualify for a New Zealand Citizen Family Relationship visa (subclass 461). This is a temporary visa, generally valid for five years, and its eligibility rules depend on the New Zealand family member’s status.
  • The ability to sponsor family members for permanent visas is different from eligibility for citizenship. It generally requires Australian citizenship, a permanent visa, or the specific status of an eligible New Zealand citizen (often called a protected SCV holder).

If your child was born in Australia, check whether they are already an Australian citizen before seeking a visa or lodging a citizenship application. In some circumstances, this applies to children born on or after 1 July 2022 to an SCV-holding parent.

A direct pathway to citizenship does not give every SCV holder the same family sponsorship rights as an Australian citizen or permanent visa holder. If a family member holds a subclass 461 visa, review their position before you change your own status.

Do you need a separate permanent visa or can you apply directly?

For an eligible SCV holder whose goal is Australian citizenship, a separate permanent visa is generally unnecessary. Permanent residence may still be worth reviewing if your immediate priority is a particular family sponsorship option, a permanent visa outcome or rights and entitlements that differ from those of an SCV holder.

Australia and New Zealand both generally permit dual citizenship. Becoming Australian does not ordinarily require you to give up New Zealand citizenship.

What does an Australian citizenship application cost?

A government application fee normally applies, with concessions or exemptions in certain circumstances. Fees are reviewed periodically, so check the latest Department of Home Affairs citizenship fee schedule before applying. Professional advice or application assistance, if required, is a separate cost.

When could specialist advice make a difference?

You may be able to check a straightforward case using Australian Government guidance. An individual assessment is particularly useful if:

  • You are unsure when your citizenship residence period began or have spent substantial time outside Australia.
  • You have a criminal history, visa refusal or cancellation, or an unusual immigration history.
  • Your partner or children are not New Zealand citizens, or your family relies on a subclass 461 visa.
  • You need to understand whether direct citizenship or a separate permanent visa better serves your circumstances.
